NOTICE UNDER THE AMERICANS WITH DISABILITIES ACT (ADA)

 

In accordance with the requirements of Title II of the Americans with Disabilities Act (ADA) of 1990, the City of Mill Creek will not discriminate against qualified individuals with disabilities on the basis of disability accessing or participating in the City’s services, programs, activities, facilities, or projects. 

Employment – The City of Mill Creek does not discriminate on the basis of disability in its hiring or employment practices and complies with all regulations promulgated by the U.S. Equal Opportunity Commission under Title I of the ADA.


Transition Plan – The City of Mill Creek anticipates beginning a comprehensive update to our ADA Transition Plan.  This plan was last updated in early 2015, and is now very out of date.


The purpose of this Plan is to ensure that public areas in the City of Mill Creek, including streets and public right-of-ways (ROWs), parks, and City facilities are compliant with all applicable ADA requirements.  In particular, the Plan sets forth steps to make all public pedestrian facilities accessible to persons with disabilities wherever feasible.  

When the update to the ADA Transition Plan is completed, copies of the Plan will be available on the City’s website and upon request at Mill Creek City Hall.

Public Input – The City of Mill Creek encourages input and comments from all residents regarding ADA issues.  Requests for improvements may be made to City staff at any time.  City staff will review requests and determine when improvements can be designed and implemented.  ADA improvements that will require a capital improvement project by the City will typically be included in biennial updates to the City 6-year Capital Improvement Plan.


Effective Communication – Upon request, the City of Mill Creek will generally provide appropriate aids and services leading to effective communication for qualified persons with disabilities so they can participate equally in the City’s programs, services, and activities.  This may include, but is not limited to, qualified sign language interpreters, documents in Braille and other ways of making information and communications accessible to people who have speech, hearing, or vision impairments.


Modifications to Policies and Procedures – The City of Mill Creek will make all reasonable modifications to policies and programs to ensure that people with disabilities have an equal opportunity to enjoy all City programs, services, and activities. 


Complaints – Formal complaints or grievances that a City facility, program, service or activity is not accessible to persons with disabilities can be directed to our Citizens Support Portal website at Contact Mill Creek


General – Anyone who requires an auxiliary aid or service for effective communication, or a modification of policies or procedures to participate in a City program, service or activity, should contact the Mill Creek City Clerk, 15728 Main Street, Mill Creek, Washington, 98012, 425-745-1891 as soon as possible but no later than 72 hours before the scheduled event.


The City will not place a surcharge on a particular individual or any group of individuals with disabilities to cover the cost of providing auxiliary aids, services or reasonable modifications of policy.

The ADA does not require the City to take any action that would fundamentally alter the nature of its programs or services, or impose an undue financial or administrative burden.
